Step 17 of 17: Declaration
The CanExport Innovation program is delivered by the Trade Commissioners Service (TCS) of Global Affairs Canada, in partnership with the National Research Council of Canada Industrial Research Assistance Program (NRC-IRAP). NRC-IRAP is responsible for assessing basic eligibility of program applicants. NRC-IRAP will refer applications deemed eligible to Global Affairs Canada TCS, who will assess the application, provide a recommendation for funding, and notify organizations of the decision taken with regard to their application. Global Affairs Canada TCS will refer successful applications back to NRC-IRAP, who will generate a funding agreement (for a contribution or grant, as recommended by Global Affairs Canada). Upon signing this funding agreement, your organization will be bound by the Conditions of Contribution or Grant contained therein.
By submitting this project application to CanExport Innovation, you agree and declare that you are an authorized person of the organization and that all information provided to Global Affairs Canada related to the project proposal is true and correct and that you are not withholding any information that may materially affect the proposal. The submission of false or misleading information is grounds for immediate refusal of this application.
I understand that the Government of Canada expects all Canadian organizations to abide by all applicable Canadian federal, provincial, territorial and municipal government laws, by-laws and regulations, as well as all applicable international laws and conventions, local laws, by-laws and regulations.
I also declare that:
- Neither we, nor our affiliates, nor, to the best of our knowledge, any of our owners, officers or employees, or anyone acting on our or our affiliates’ behalf, are currently under charge or have been convicted in a foreign jurisdiction within the past five years for bribery or corruption offences contrary to any applicable criminal law dealing with bribery or corruption of public officials. We understand that such foreign charges or convictions will be taken into account when the CanExport program is considering whether to provide future funding;
- Neither we, nor our Affiliates, nor, to the best of our knowledge, any of our owners, officers or employees, or anyone acting on our or our Affiliates’ behalf, are currently under charge in Canada for bribery or corruption of public officials under the Corruption of Foreign Public Officials Act (CFPOA) or the Criminal Code; or have been convicted in Canada of such conduct during the past five years;
- Neither we, nor our Affiliates, nor, to the best of our knowledge, any of our owners, officers or employees, or anyone acting on our or our Affiliates’ behalf, are currently barred from contracting with or are otherwise under sanction from the Government of Canada due to bribery or corruption offences; non-engagement with a National Contact Point (NCP) for the Organisation for Economic Co-operation and Development (OECD) Guidelines for Multinational Enterprises; or non-compliance with Responsible Business Conduct (RBC) best practices.
- Neither we, nor our Affiliates, nor, to the best of our knowledge, any of our owners, officers or employees, or anyone acting on our or our Affiliates’ behalf, are currently barred from contracting with or are otherwise under sanction from an inter- governmental organization or an international financial institution due to bribery or corruption;
- We undertake that neither we, nor any of our owners, officers or employees, nor our Affiliates will knowingly engage, directly or indirectly, in bribery or corrupt business practices contrary to any applicable Canadian criminal law dealing with bribery or corruption of public officials, including but not limited to the Corruption of Foreign Public Officials Act (CFPOA) and the Criminal Code.
- We understand that CanExport expects Canadian organizations and their affiliates shall operate in a manner consistent with the OECD Guidelines for Multinational Enterprises on responsible business conduct. Further, we understand that CanExport expects that Canadian organizations shall cooperate with Canada’s National Contact Point (NCP) for Responsible Business Conduct (RBC) and the Canadian Ombudsperson for Responsible Enterprise (CORE) and that the Organization shall cooperate with any proceedings before the NCP or CORE which involve a request for review that names the Organization. We understand that CanExport shall not provide support to any Canadian organization that declines to engage in good faith with an NCP or CORE process and does not reflect RBC best practices.
- We acknowledge that Global Affairs Canada may share information concerning bribery or corrupt business practices so obtained with Canadian law enforcement authorities.
- We understand that CanExport expects Canadian organizations and their affiliates active in any country to operate in a manner that respects human rights, including with respect to forced or compulsory labour and all applicable laws, as well as to operate transparently and in a manner that seeks to meet or exceed international RBC standards such as the OECD Guidelines for Multinational Enterprises and the United Nations Guiding Principles on Business and Human Rights. I understand that CanExport will not provide funding to any Canadian organization that is found to be knowingly engaged in business conduct inconsistent with these standards.
- We have not knowingly sourced, directly or indirectly, products or services from a supplier implicated in forced or compulsory labour or other human rights violations. We understand that any evidence that we have knowingly done so will result in the immediate termination of any existing funding agreement with CanExport and a prohibition on any future application.
- This Declaration remains in effect for three (3) years from the date it is submitted. We acknowledge that, during this period of validity, the Organization has an ongoing obligation to report to CanExport any material changes to statements in this Declaration concerning bribery, corrupt business practices and human rights violations, including with respect to forced or compulsory labour and all applicable laws. CanExport reserves the right to terminate a contribution or grant agreement if and when a recipient fails to meet its obligations.
- We acknowledge that this completed Declaration does not constitute a commitment by the CanExport program to approve funding in the future. All funding decisions are made at the discretion of CanExport officers based on information at their disposal.
- We agree that NRC may translate, publish and make available to the public, information about our Organization, and our proposed project in accordance with the Government of Canada’s Guidelines on the Proactive Disclosure of Grants and Contributions. Published information may include, but is not limited to organization name, project title, project summary and of the funding amount
